Terms & Conditions

These Terms and Conditions ("Agreement") govern the sale and use of industrial equipment ("Products") by McLaren Machines ("Company"). By placing an order for the Products, the Customer ("Customer") agrees to be bound by and comply with these Terms and Conditions.

 

1. WARRANTY

1.1 Limited Warranty
McLaren Machines warrants that the Products will be free from defects in material or workmanship for a period of one or two years from the date of delivery ("Warranty Period"), depending on the machine. The warranty is limited to the provision of parts and service as provided by the original manufacturer of the Products.

1.2 Warranty Limitations
The warranty is void if the Products are used for any purpose other than their intended purpose, are subjected to misuse, abuse, or neglect, or if the Products are modified or altered in any way. Warranty coverage does not extend to wear and tear or consumables.

1.3 Lifetime Technical Support
McLaren Machines offers lifetime technical assistance via telephone, email, and online support. However, such support is limited to the availability of resources from the original manufacturer, and McLaren Machines makes no representation or warranty regarding the continuity or quality of such support.

 

2. PAYMENT TERMS

2.1 Prepayment Requirement
The Customer agrees to make full prepayment for the Products, including applicable taxes and shipping costs, prior to the release of the Products from McLaren Machines' warehouse. Payment must be received and cleared before the Products will be shipped.

2.2 Final and Non-Refundable Orders
Orders placed by the Customer are final. The Customer acknowledges and agrees that once an order is confirmed, it cannot be amended, altered, or canceled.

 

3. TRANSPORTATION AND DELIVERY

3.1 Transport Arrangements
McLaren Machines can assist in arranging transport for a fee. However, McLaren Machines shall not be liable for any acts or omissions by third-party transport companies, and any such transport services are provided solely at the Customer’s risk.

3.2 Customer’s Responsibility for Unloading
The Customer is solely responsible for ensuring that appropriate unloading equipment, such as a forklift with a minimum capacity of 2,500 kg and forks of 6-8 feet in length, is available at the delivery site. A loading dock is recommended, where applicable. McLaren Machines shall not be liable for any delays, damages, or costs incurred due to the Customer’s failure to provide proper unloading equipment.

3.3 Delivery Timeframe
Delivery estimates for non-stock items ordered by the Customer range from 4 to 26 weeks, depending on product availability and order specifications. Once payment is received, equipment in stock is typically shipped from our warehouse within one week, subject to transport availability. These delivery timeframes are estimates only and are subject to delays due to factors including, but not limited to, weather, supply chain disruptions, and production schedules.

 

4. INSTALLATION AND CUSTOMER RESPONSIBILITIES

4.1 Rigging and Setup
The Customer is responsible for providing all necessary equipment and personnel for unloading, rigging, and setting up the Products at the designated location. McLaren Machines does not provide rigging or setup services as part of the sale of the Products.

4.2 Electrical and Mechanical Connections
The Customer is responsible for ensuring that all electrical and mechanical connections are properly installed. McLaren Machines recommends that an electrician be present for the installation of power connections to ensure compliance with safety standards. 

4.3 Installation Services
Installation services, if required, can be arranged for an additional fee. The Customer must ensure that the installation environment is prepared, and all necessary utilities are in place prior to the installation.

4.4 Acceptance of Products
It is not recommended that the Customer accept any jobs involving the Products until they have been properly installed, tested, and fully operational. Delays may occur, and McLaren Machines shall not be liable for any business interruption or loss of revenue resulting from such delays.

 

5. LIMITATION OF LIABILITY

5.1 Use of Products
The Customer acknowledges that the Products must only be used for their intended purposes as specified by the manufacturer. The Customer is responsible for any damages resulting from improper operation. Any use of the Products beyond their intended design, or failure to comply with the manufacturer's instructions, will void any warranty and shall relieve McLaren Machines from any liability.

5.2 Safety Risks
The Customer assumes all risks associated with the operation of the Products. McLaren Machines is not liable for any accidents, injuries, or damages that result from the use, setup, or operation of the Products. The Customer is responsible for ensuring that all operators are trained, and appropriate safety protocols are followed.

5.3 Equipment Compliance
It is the customer's responsibility to ensure that equipment meets the required standards and complies with all applicable regulations, certification requirements, and safety guidelines.

 

6. Media & Branding Usage

6.1 Usage Consent
By purchasing from McLaren Machines, the Customer grants McLaren Machines permission to use their company name, logo, images, and videos related to the purchased equipment for marketing, advertising, and promotional purposes, including on McLaren Machines' website, social media, and in print materials. If the Customer requests in writing to remove specific materials, McLaren Machines will promptly remove all such materials from future use and public-facing platforms.

 

7. ACCEPTANCE OF TERMS

7.1 Acknowledgment and Agreement
By placing an order with McLaren Machines, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions, including all limitations of liability, warranty disclaimers, and customer responsibilities.

7.2 Modification of Terms
McLaren Machines reserves the right to modify these Terms and Conditions at any time. The Customer agrees to be bound by the most current version of the Terms and Conditions, which can be found on McLaren Machines’ website or obtained upon request.

 

8. GOVERNING LAW AND JURISDICTION

8.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of laws principles.

8.2 Jurisdiction
Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Quebec.
